Reservations in public employment for persons with disability and for SC/STs have been treated differently by the Supreme Court.

The Union argued that reservations in promotions for Persons with Disabilities shouldn't apply to promotions in all government services.

On September 21st 2021, a three judge bench, heard the Union’s petition seeking clarifications on the Siddaraju judgment.

The Supreme Court has held that persons with disabilities have a right to reservation in promotion under Article 16(4).
