Review: Pre-Judgment Matrix

An assessment prior to the judgment of the Rafale Fighter Jet Review hearings taking into consideration various factors such as the grounds for review and whether the 2018 judgment should be reversed. The pre-judgment matrix analyses the likelihood of judicial review by the Court particularly in terms of the factors which may influence review such as factual errors and the emergence of new evidence. It also weighs several important arguments in favour of, and against reversal of the judgment to gain a nuanced understanding of the probability of reversal.
