Elevation of Justice KureshiJuly 15th 2019
The Supreme Court is hearing a plea by the Gujarat High Court Advocates Association (GHCAA) for the immediate appointment of Justice Kureshi as the Chief Justice of Madhya Pradesh High Court. They contend that the Union has deliberately side-tracked his appointment and thereby violated the procedure dictating judicial appointments.
Today, the Supreme Court called on the matter for early hearing. It served a copy of the writ petition to Solicitor General Tushar Mehta.
Senior Advocate Arvind Datar, representing GHCAA, submitted that the Union government’s ‘deliberate inaction‘ infringed upon the judiciary’s primacy in appointments. He argued that this violates both Article 217 of the Constitution and law established by the Second Judges Case.
The bench led comprising CJI Ranjan Gogoi and Justice Deepak Gupta listed the matter for July 22nd.
