A five-judge Bench constituting CJI Dipak Misra, DY Chandrachud, AK Sikri, Ashok Bhushan and AM Khanwilkar JJ heard the challenge to the Aadhaar Act challenge for 38 days. It was the second longest hearing in the history of the Indian Supreme Court. The Court reserved judgment on May 10th, 2018.
The Court has to decide the following:
- Is the Aadhaar Act constitutionally valid?
- If not, can it be made constitutionally valid, either by reading down certain Sections and/or by reading in certain provisions?
