Rajeev Dhavan: Encoding Secularism in Law

In this EPW piece,Mr. Rajeev Dhavan critiques the Faruqui judgment of 1994 which upheld the land acquisition of Babri land by Central Government. He also examines the judicial observations dealing with “essentiality” of Mosque in Islam and argue that such remarks defeat the secularism principle.  He argues that by acquiring Babri land on which the Mosque stood, the judgment in its slant favoured Hindu Majority claims over Muslim claims.
